Money Making Schemes

This brings us to his best buddy, Joe "Nickels" Banner. These guys are best buddies. He has a degree in economics, used to run/own a chain of clothing stores and knew Jeffy boy from the old Boston days. All the necessary credentials to be president of an NFL team, right?

With a knack for pinching pennies and a gift for marketability, Joe has done wonders.  It was his idea to coin the terms "pedal to the metal" and "the gold standard".  He consistently shines up garbage, presenting the public with fool's gold while passing it off as the real thing. He has a contract extension through 2013, so get used to disappointment.

Andy "Big Red" Reid.  Andy, Andy, Andy...how many times have those words left your mouth, usually in a rapidly rising voice, followed by nervous pacing or objects being thrown?

He is the head coach and vice president of the team.  As if he's so skilled at the one job that he needs the challenge of the other.  10, 11, 12 years and counting of the same nonsense.  Promoting incompetent people like Sean "McDoormat" McDermott.  Making no discernible in-game adjustments.  Using the same tired schemes over and over.  Passing the ball 70% of the time has never won a SB, but don't bother telling Andy that.

Quite possibly the most stubborn person you'll ever observe in your life.  Refuses to run the ball, even when you have guys like Brian Westbrook and LeSean McCoy in the backfield.  Even when you are lining up James Thrash and Todd Pinkston as your wideouts.  He undervalues play-making positions like D-line and LB, instead preferring to fill them with seventh round Draft picks and cast-offs from other team's practice squads.  Andy will gladly trade you his first round pick today for two fifth round picks three years from now.  Nothing changes with this guy.  Nothing.  Never has and never will.

Now here is where YOU can have an impact: Express your frustrations with the same old story in writing to the following:

Chris Huhne will lead a review into the use of feed-in-tariffs (FITs) in the UK in a bid to end subsidies going to large scale solar farms rather than small scale users.

The Secretary of State for Climate Change acknowledged the successful take-up of photovoltaic panel in Britain so far since the FIT scheme began last year.

Since then 21,000 installations have been registered, with the majority of these apparently having domestic applications.

However Huhne highlighted his concerns that the subsidies were making their way into the pockets of big businesses rather than to small scale users.

“I have become increasingly concerned about the prospect of large scale solar PV projects under FITs, which was not fully anticipated in the original scheme and could, if left unchecked, take a disproportionate amount of available funding or even break the cap on total funding,” said Huhne.

“Several large solar installations have already received planning permission. Industry projections indicate there could be many more in the planning system.”

Huhne thinks a procedural review may be necessary to address a number of problems.

“In light of this uncertainty and the risk that such schemes could push FITs uptake off trajectory and may make the Spending Review savings difficult, I have decided to end the potential for damaging speculation and bring forward the review of the Scheme to look at ways of correcting these early teething problems.”

“I recognise that industry needs a long term plan for investment in which it can have full confidence,” he continued.

“Today I am announcing a comprehensive evidence based review in to the FITs scheme and, to provide further certainty to the renewables industry, I can confirm that we also hope to publish next month measures to support renewable heat within the envelope agreed at Spending Review."

The review of FITs will be completed by the end of the year, with tariffs remaining unchanged until April 2012, unless there is specific need for greater urgency.

Some say Huhne may be rather hasty in tinkering with FITs, including Ash Sharma, Research Director at IMS Research.

Talking to TechEye, Sharma says: “While it may mean that installation demand is pulled forward, with many businesses seeking to invest before any changes are implemented, in the long term it may damage both the commercial and residential markets rather than provide any benefits.”

“The government are perhaps concerned that the market may take off to quickly, alongside of course wanting to save money, but this may be too early in the UK market’s growth.  In fact the British market was only around one percent the size of the German one last year, having only had a subsidy programme for eight months.”

Furthermore, the UK is likely to fall even further behind other EU countries.

“We are way behind Germany of course, but we are also falling a long way behind many other countries such as Italy, France, Belgium, Greece and more.”

“This could in fact have a negative effect on the economy rather than helping it, with jobs for installations and distributors going if there is no demand for panels due to unattractive prices.”

“For example if the big businesses are not attracted to countries large scale solar plants then that will have a knock on effect on many others area, such as making component prices more expensive for residential users, which of course consequently means that there is less demand to have panels installed.”

Affiliate Making Money

In her email to us Tracy explained why she was cautious about believing it really was her Facebook friend, and resisted clicking on the link:

"I was suspicious because it's the only time she's ever tried to talk to me, she doesn't appear to use FB much, she never responded to my "how are you doing?", and I am convinced that if she did try to talk to me the wording would have been more literate, having known her back in school. Then when I ask her the test questions she just goes off line. Hmm."

So, just what was going on?

Well, Tracy's friend's Facebook account has most likely been hacked, and scammers are using it to spread spam messages. Their hope is that by contacting users via the instant chat feature they might be able to trick more people into clicking on their links.

And seeing as the scammer didn't reply to the "how are you doing?" message from Tracy, it's possible that the messages are using an automated script.

And if you did click on the link, in this example, you would have been taken to a webpage purporting to be the "International High IQ Society". A popup message on the page states:

An IQ Challenge was sent to you from:

Hazel Phillips

Think you can beat them?

[Accept/Decline buttons]

If you click accept, you are redirected through a number of different webpages. When we tried it, we ended up on a website called FlirtyMob.

which describes itself thus:

..FlirtyMob is a subscription service. Until you opt out, you have unlimited access to the chatroom charged 3GBP every 7 days plus operator standard data charges. To opt out..

Of course, it's very possible that FlirtyMob is not behind the abuse of Facebook users' accounts and is not aware of the spamming that has taken place. Indeed, if you clicked on the link from another part of the world you might have been taken to an entirely different website. Perhaps the spammers are earning affiliate commission from driving traffic to sites such as FlirtyMob.

It could have been worse, of course. We've seen examples in the past where Facebook users receive messages seemingly from friends stranded overseas, asking to have money wired to them as they have lost their passport, wallet and air tickets.

Fortunately, if you have your wits about you like Tracy did you'll be able to quickly tell if a message which arrives out of the blue from a Facebook friend should be treated with suspicion. Hopefully her friend will also realise to better protect her Facebook account in future, too.

So treasure your memories of making root beer as a child at school - you never know how useful they will be one day.

UPDATE: DirecTV has given Consumerist its side of the story.

_________________

For years, DirecTV has been advertising its "refer your friends and get $100" promotion. But for one DirecTV customer in Florida, that referral didn't end up profiting her; in fact, it ended up draining her bank account after that friend passed away.

The woman referred her friend to DirecTV a few months ago, but when that friend died unexpectedly, DirecTV debited at least $800 — without notifying her — from her bank account to pay for her late friend's unpaid service.

"I was never told of this," she told the NBC affiliate in Jacksonville. "I didn't see any of this. I never signed for this. I was blindsided. I have no record of this....

"I have a sick child at home that I couldn't afford to buy her Pedialyte... I had to ask for help from family. I had to get money for gas to get to work today, and DirecTV hasn't offered anything."

There is nothing in the DirecTV terms and conditions that ties a referrer's account to anyone they refer to the company. But the customer says that all her phone calls, letters and faxes to DirecTV failed to get her an explanation or refund.

It wasn't until after the local TV news got involved that she got any sort of response from DirecTV, who wrote, "This is definitely not part of DirecTV's policy. If a customer refers a friend, they are not responsible for making payments on their friend's account."

Eventually, she received a call from the company's president, who told her that DirecTV would be refunding all the money that was taken from her account. The next day it was back safely in her bank.

We've reached out to DirecTV to see if anyone there can explain what caused this huge error and will update if we get a response.

foreclosure search

A story at Huffington Post by Shahien Narisipour and Arthur Delaney, about how a couple lost their home as a result of the Administration’s HAMP program, actually serves to illustrate a broader issue, namely, how servicers’ dubious fees can put mortgage borrowers hopelessly under water.

It is critical to understand that it is not uncommon for borrowers to lose their homes thanks to servicer errors and abuses. And this bad practice has policy implications. Whenever we discuss “fix the housing mess” solutions that involve loss sharing, like giving viable borrowers a deep principal mod, some readers react that “deadbeat borrowers” are getting a free ride, and often will contend that they were irresponsible and need to take their medicine.

This black/white picture is simplistic and misleading. Yes, there were people who borrowed too much in the bubble. Guess what? Those people tended to have been subprime borrowers and the resets on teaser loans had pretty much concluded by the end of 2008. As a result, they would have been relatively early to hit the wall. Many have already lost their house.

Another cohort could have made the payments if they hadn’t lost their job or suffered a reduction in hours. And remember how soft this job market it is, so even people who had savings that would have been enough to carry themselves through a typical period of job search are coming up short. These individuals are collateral damage of the global financial crisis, but they too often are depicted as having been reckless rather than unlucky

But the third cohort is most often overlooked and most troubling, which is victims of servicer abuses. This problem is very much underdiagnosed because the servicer is judge, jury, and executioner as far as its charges are concerned. Borrowers find it a pitched battle to get the detailed payment records from servicers, even with a lawyer’s help. Even then, the statements are usually incomprehensible. Attorneys have told me they typically have to hire a forensic accountant both to get to the bottom of the mess and to serve as an expert witness.

Given how expensive it is to fight this sort of case on the real issue, the borrower’s belief that the servicer has overcharged him, many of these cases are instead fought on the simpler grounds of standing. That feeds the perception that borrowers are taking advantage of bank errors, rather than having legitimate grounds for opposing a foreclosure.

So the best we can go by is estimates by attorneys that actually handle these cases. Remember, most people who really cannot afford their house will not put up a fight. Nevertheless, Diane Thompson, Counsel for the National Consumer Law Center said in testimony before the Senate Banking Committee last November that in 50% of the cases she handled, the foreclosure was the result of a servicer driven default. I’ve had attorneys who’ve handled hundreds of cases put the percentage even higher.

Now some readers no doubt may be skeptical that servicer screw-ups or venality can have that sort of impact, so let’s look at the Michigan couple highlighted in Huffington Post as a case study.

The background is a bit ugly. The Garwoods had missed one payment, but this apparently was not unsalvageable; the husband’s roofing business was seasonal. Their servicer, JP Morgan Chase, contacted them and encouraged them to enroll in HAMP.

The HAMP trial mod, which was supposed to last three months, instead ran nine months and lowered their payments by about $500 a month. When they were ultimately refused a permanent mod (despite hearing encouraging noises from the servicer in the meantime), they were presented with a bill for the reversal of the reduction, plus fees, of $12,000.

Stop a second and do the math. Let’s be unduly uncharitable to JP Morgan and assume “about $500″ means $540. $540 x 9 is $4,860. That means the fees and charges were $7,140, or nearly $800 a month.

How can charges like that be legitimate? Answer: they almost assuredly aren’t. The payments were reduced as a result of a trial mod, so any late fees would be improper. Thus the only legitimate charges would be additional interest, perhaps at a penalty rate. So tell me how you have interest charges of nearly 400% on an annualized basis on the overdue amount and call them permissible? I guarantee there is not a shred of paperwork anywhere that can support this level of interest charge, either with the investor or with the borrower.

But as we indicated, it’s a hopelessly uphill battle to fight servicers on this issue. The Garwoods threw in the towel and stopped paying last spring. One can dispute whether that was the best move, but even if they have paid the normal mortgage amount due in full each month, it is almost a certainty that JP Morgan would have credited the payments, contrary to the pooling and servicing agreement, to fees first, assuring that the current amount due would be insufficient and thus not arresting the compounding charges. In other words, unless the Garwoods acceded to the bank’s bogus charges and paid the $12,000 in full, there was no way out of compounding fee hell.

We used to call that level of charges loan sharking and would send people to jail for it. It has now become standard operating procedure in banking and no one bats an eye.

Let me just correct that last paragraph. MERS was created by the mortgage industry to avoid recording fees at county offices. This notion that the county offices couldn’t handle it is just not true. The banks didn’t like that they were charged for the transfer.

As this mentions, Arnold wasn’t just a figurehead CEO, he basically was MERS. They only have a handful of employees, and he’s been there since 1996. As much as this is a personnel decision, it’s also the end of MERS, in a sense. Throughout the foreclosure fraud crisis, MERS has been exposed, not only as a tax avoidance scheme, but as a registry which introduced tremendous complexity into the securitization process, and led to a breakdown in the mortgage assignment process. The “electronic handshake” pulled off by entering mortgage transfers into the database simply does not have the same force of law as reality, and MERS has no internal standards or tracking of the transfers put into the database, making them only slightly more credible than fiction. And MERS trying to both stand in as the mortgagee and also claim no financial responsibility in the mortgage makes absolutely no sense, as several judges have pointed out. You cannot justify MERS without offering up a series of lies and misstatements.

Numerous states have MERS lawsuits floating through the system. I don’t see how the company survives, or at least how it becomes more trouble for the banks who own it than it’s worth. Arnold must have thought so too.

This is important for just about everyone as we all buy things. Some countries, as I understand it, do not have the same concept of credit cards that Americans do, so I will be writing this from an American perspective. I worked in the credit industry for quite some time and have extensive experience in these matters.

Obviously when you buy something you have to pay for it. If you have the money you can pay for it then and there, or if you don't you can choose to finance it. Some things are normal to finance. Things such as student loans, cars, and a home are things that just about every person will finance. There are also things that are being financed much more in these times than in the past such as vacations, trendy clothes, video game systems and the like. There is argument that the "we want it now, but pay later culture has another financial shock coming the economy's way in the credit card meltdown" I have been a credit analyst that approved loans and credit cards and collected them in my career. I do think there is going to be problems with the credit card system one day and greater than the problems we are already seeing.

There are different ways that items can be financed. One of the best ways is 0% interest financing. Here you borrow money and don't pay any interest. Companies usually do this when they are trying to drum up business. They also have no interest and no payments for a year or longer. This is the banker's way to make money. How? Easy. Most people will put off and put off paying the payment while it is interest free. By doing this at the end of it you get hit with all that interest. Most companies also compound the interest. All credit cards compound interest.

Compounding interest basically means that the interest you owe

Is calculated at the end of the day with a daily periodic rate (see your credit card statement. It will be really small like less than .01% in some cases. When you borrow money you do not want it to compound, but in savings you do want it to compound. To put it simply you are charged interest on top of interest every single day.

You also can just use a credit card. I realize it has to be done, but can be a bad idea. I personally have several credit cards, but owe a balance on none. This is because I learned the value of "want versus need". I always ask do I want something or need it. If you want it I make sure I am getting the best price and quality and deal. If I need it I check out the same but you need what you need. If you car needs repairs you cant really skimp on that, but if I need a new video game I can wait until the price goes down or buy one used.

Now when people run a business there will almost always be financing. Not many people can buy everything they need all the time. This is especially true of raw materials or goods to resell. If you sell toys on eBay on a very big scale it is very possible that you may have to run a balance on a card to get your inventory. When you sell it you then pay the card off, hopefully at least. The main thing is to not get caught in a bad situation. It is very easy to do. Always look around if you have good credit someone is always offering a deal in order to get your business.

A final tip deals with automobile financing. Get your own. The car finance manager almost always will charge you more than you can get if you get it prior to the purchase. The reason is they make money off that. Typically you will pay at least .5% higher with good credit than what you would find on your own. If you have "challenged credit" it can be up to 5%. This can add up to several hundred to several thousand dollars over the long runs. In all fairness the dealerships do this because that is how they make money there. Not all do this and often times if you are financing through the companies own finance (BMW finance, Toyota ect ect ect) then you may not pay any spread (the difference between what you can get and what they charge you). Hope these tips help.

There are exceptions of course to this. Not everyone will listen also. I am sure there are grandparents who would not deny a present even if they could not afford it, but that is a choice people make. Sometimes you may finance a wedding. To each their own. When I got married I told the boss (wife) that with the marriage failure rate I was not going in debt for it. We had a great time and I took it all out of savings. I have spoken to people who have had to file bankruptcy after paying thirty thousand dollars for a daughters wedding. I believe in "judge not less ye be judged" but the people I was speaking to had a house and car what was not worth that much adding the value of both together. There is such a thing as living above your means. The bad thing is that they got divorced about a year prior to speaking with me about a mortgage trying to fix the mess they were in.
