The Health Benefits Of Raw Milk

From Grass-Fed Animals

In 1970, I went to live on the island of Martha's Vineyard. I was quite ill with gastrointestinal problems. I began living mostly on seafood, fresh vegetables and salads, and raw milk and eggs purchased from a local farmer, with a little meat and whole grain bread. My health problems, which had been intractable for years, disappeared.



Raw milk remained a mainstay of my diet. Since 1981 I have strongly recommended raw milk to thousands of people who have seen me in my practice as a naturopathic physician. I practice in Connecticut, where we enjoy the right to purchase certified raw milk throughout the state (with the exception of the town of Fairfield, where a fascist local health board has instituted an unchallenged-for-lack-of-funds town ordinance prohibiting the sale of raw milk.)



The raw milk available in the part of Connecticut where I live is from Debra Tyler's farm in Cornwall Bridge, called "Local Farm." Debra has nine cows on fourteen acres. Eight health food stores in central and northern Connecticut pick up milk regularly at Local Farm. There are about a dozen other certified raw milk dairies among Connecticut's 210 dairy farms.



Debra has Jersey cows. Most farms have Holsteins, which provide large quantities of milk, but milk that is lower in protein, fat and calcium. Jerseys were originally bred by the French to produce milk for cheese making. The fat content of Debra's milk during the warm months is about 4.8 percent, well above the normal 3.5 percent for whole milk. Debra's cows eat mostly grass in the spring, summer and fall, and mostly hay in the winter (each cow consumes a forty pound bale a day!), with a few pounds a day of ground corn and roasted soybeans (five to one corn to soybeans ratio).



Local Farm milk is certified organic. Certification costs several hundred dollars a year in fees and considerable paperwork. It also means that Debra must sometimes pay more for certified feed from faraway places than for locally produced feed she knows to be organic but which is not certified. This raises the question-if you know and trust the local farmers who produce your food, does it really have to be certified?



TESTIMONY ON RAW MILK

The last time the right of the people of Connecticut to purchase raw milk was seriously threatened was in 1994 when the state Environmental Committee held public hearings on the certification of raw milk, before voting almost unanimously to continue licensing new farms and allowing raw milk to be sold. I testified at those hearings. My testimony was framed to respond to objections to raw milk raised by the state health department and to document the benefits of raw milk. To quote from that testimony:



"The state epidemiologist writes that 'It has yet to be demonstrated that raw milk has any beneficial health effects. . . ' He cites articles attached to his letter. In one article, 'Unpasteurized Milk, The Hazards of a Health Fetish' (Journal of the American Medical Association, 10/19/84), the authors make a series of misstatements about the research of Francis Pottenger before concluding that raw milk has no health benefits. I detail these charges as follows in the paper I've given the members of the Committee.



"Now what Pottenger actually did in some of his experiments is this. He used four groups of cats. All received for one-third of the diet raw meat. The other two-thirds of the diet consisted in either raw milk or various heat-treated milks. The raw milk/raw meat diet produced many generations of healthy cats. Those fed pasteurized milk showed skeletal changes, decreased reproductive capacity and infectious and degenerative diseases.



"Now just who was Francis Pottenger? He was the son of the physician who founded the once famous Pottenger Sanatorium for treatment of tuberculosis in Monrovia, California. He completed his residency at Los Angeles County Hospital in 1930 and became a full-time assistant at the Sanatorium. From 1932 to 1942, he also conducted what became known as the Pottenger Cat Study.



"In 1940, he founded the Francis M Pottenger, Jr. Hospital at Monrovia. Until closing in 1960, the hospital specialized in treating non-tubercular diseases of the lung, especially asthma.



"Dr. Pottenger was a regular and prolific contributor to the medical and scientific literature. He served as president of several professional organizations, including the Los Angeles County Medical Association, the American Academy of Applied Nutrition and the American Therapeutic Society. He was a member of a long list of other professional organizations.



"Pottenger's experiments met the most rigorous scientific standards. His outstanding credentials earned him the support of prominent physicians. Alvin Foord, MD, Professor of Pathology at the University of Southern California and pathologist at the Huntington Memorial Hospital in Pasadena, co-supervised with Pottenger all pathological and chemical findings of the study.



"One particular question that Pottenger addressed in his study is one that modern science has largely ignored. It has to do with the nutritive value of heat-labile elements-nutrients destroyed by heat and available only in raw foods.



"In his article 'Clinical Evidences of the Value of Raw Milk,' Pottenger writes: 'Some of the factors transmitted by milk are thermo-labile [sensitive to heat]. Though their destruction may not produce death, their deficiency may prevent proper development of the child. This may show in the development of an inadequate skeleton or a decrease in resistance. . . . delay in development of osseous centers is noted more frequently in those children. . . receiving heat treated milk. It is particularly absent from the raw milk fed children. . . . I am basing this discussion on analysis of 150 children whose parents have consulted me because of respiratory allergies. Many other workers. . . have also shown that treating milk by heating interferes with its proper assimilation and nutritional qualities. . . . The best milk from a nutritional standpoint is raw milk. . . . Heat-treating milk interferes with calcium metabolism causing. . . delay in bone age and small bones. . . . The interference with calcium metabolism as shown in the bones is only a physiological index of disturbed metabolism throughout the body.'



"I have prescribed raw milk from grass-fed animals to my patients for nearly fifteen years. Time and again I have seen allergies clear up and dramatically improved health. Particularly in children, middle ear infections usually disappear and do not recur on raw milk. Both children and adults unable to drink pasteurized milk without problems have thrived on raw milk. In hundreds-perhaps thousands-of my patients using raw milk, not one has ever developed a salmonella, campylobacter, or other raw-milk-related infection.



"In the letter cited above, the state epidemiologist states that 'The processes of certification and/or inspection do not guarantee that raw milk will not be contaminated with pathogenic organisms.' He also lists a host of microorganisms that are alleged to be transmitted by raw milk, not mentioning that, as the literature accompanying his letter makes clear, the only organisms even potentially associated with the consumption of certified raw milk are salmonella and campylobacter. And in one of the articles he cites, 'The Hazard in Consuming Raw Milk' (in The Western Journal of Medicine), the authors actually state that 'Salmonella and campylobacter diseases in humans are generally not serious. But in persons with compromised health (particularly those with malignant conditions and immunosuppressed by disease or therapy), these infections may be serious.'



"So, the gist of the state's argument against certified raw milk is that it might possibly on isolated occasions cause serious disease in some people whose immune systems have been compromised by the toxic effects of chemotherapy. And because of this very slight risk, those of us who might choose to drink certified raw milk for the benefits I have catalogued should be denied that right."



Fortunately, the members of the Environmental Committee saw through the shallowness of the state's argument and voted in favor of raw milk.



Milk in History and Evolution

Not everyone agrees that milk should be part of the human diet after infancy. The argument is made that just as all other species drink no milk after weaning, neither should we, especially that of another species. Many adults have difficulty digesting pasteurized milk, and allergies to pasteurized milk products are common. While this lends credence to arguments against milk, such reactions are usually due to pasteurization itself and the poor quality of conventionally produced milk and milk products. While for some individuals genetic influences play a role, for most people, the body's reaction to milk depends largely upon the quality and state of the particular milk used.



The Swiss of the Loetschental Valley were one of the few native groups Weston Price studied that used milk. (The others were certain African tribes, including the Masai.) The Swiss valley-dwellers used raw whole milk, both fresh and cultured, cheese and butter, all in substantial quantities. The milk was from healthy, grass-fed animals and was used unpasteurized and unhomogenized. Such foods clearly can play a major role in a health-building program for the individual genetically enabled to utilize these foods well. They are a rich source of fat-soluble vitamins A and D and other crucial nutrients in short supply in diets lacking in high quality animal fats. (Contrary to popular opinion, liberal amounts of animal fats, particularly from grass-fed animals, are essential for good health and resistance to disease.)



Yet it is possible to attain optimal health without dairy foods. Price discovered groups using no dairy foods that had complete resistance to dental decay and chronic disease; their diets invariably included other rich sources of animal fats, calcium and other minerals. The soft ends of long bones were commonly chewed, and the shafts and other bones were used in soups.



Modern medicine has discovered the importance of a substantial intake of calcium. Several recent studies have linked high blood pressure and other problems to chronic subclinical calcium deficiency, including increased incidence of colon and prostate cancers in men and osteoporosis and osteoarthritis in both men and women. Paradoxically, other problems are associated with high consumption of dairy foods; this has not gone unnoticed by researchers, nutritionists and holistic physicians.



The difference between fresh raw milk from grass-fed cows and processed milk explains the paradox. This concept has not been considered in attempts by today's medical community to explain the health effects of dairy foods.



Domesticated animals were first used for milk eight to ten thousand years ago, as a genetic change affecting mostly people in Europe, the Middle East and parts of Africa enabled them to digest milk as adults. Milk from domesticated animals then began to become important as a human food. With domestication and settlement, fewer wild animals were available; as groups of people roamed less, they hunted less, eating more grains and vegetables. In some cultures, milk replaced animal bones as the chief source of calcium and some other minerals.



In indigenous cultures where adults used milk, often it was used as cultured or clabbered milk. This is similar to homemade raw yogurt, and it is partially predigested-much of the lactose (milk sugar) has been broken down by bacterial action. This process must be accomplished over a period of several hours in the stomach when one drinks fresh milk; yogurt or clabbered milk is much more easily digested than fresh milk.



Adaptations in evolution are always the effects of particular causes. Humans developing the ability to digest milk into adulthood possessed a survival advantage; such changes are the basis of evolution. Put simply, many human beings evolved the ability to easily digest raw milk because raw milk from healthy, grass-fed animals gave them an adaptive advantage; it made them stronger and more able to reproduce. Such milk remains a wonderful food that provides us with fat-soluble nutrients, calcium and other minerals that are by and large in short supply in the modern diet.



In the six years since I presented the testimony quoted above, I have become more convinced than ever of the value and importance of raw milk in the diets of people of all ages. For many of the people who eat in the manner I recommend, raw milk is the chief source of enzymes. I believe enzymes are a critical component in recovering from disease and establishing and maintaining health. Hundreds of people I've seen have used Local Farm raw milk as an essential part of their naturopathic treatment.



There isn't a day that goes by that I'm not thankful that I live in a state where bureaucrats and medical monopolists have not stripped us of what should be an inalienable, constitutional right. I mean the right to purchase raw milk and other healthy, locally produced foods directly from the people who produce them.



It's impossible to overestimate the importance of the work Debra Tyler and farmers like her are doing. I long to see the day when all Americans have the right to purchase locally produced raw milk, meat, fowl and other farm products directly from the farmers who produce them. I hope to see the day when the current yoke of prohibitions and bureaucratic red tape will be thrown off, and we once again will be free to produce and consume truly healthy foods. The men and women who founded this country did not intend for commercial interests to control the food supply and thus our health. These are rights of the people, and they are rights that have been stripped away. We need to work together to regain them.

The other day I blogged with a funny Santa photo of my daughter, which I made into our holiday card that year. InDinero

Billed as the Mint.com for small businesses, InDinero launched in early July and is a real-time financial dashboard for companies. The Y Combinator-backed startup is led by 20-year-old Jessica Mah, who got the idea for InDinero while she was selling items on eBay in middle school.

"I had no idea how much money I was actually making," Mah told us in July. Mah, who is obviously some kind of super-genius, graduated from UC Berkley's computer science program this year at the age of 19 and promptly began putting the finishing touches on the Web app, which closely resembles Mint.com.

InDinero is free for up to 50 transactions per month, $29.95 for up to 500, and $99.95 for an unlimited number of monthly transactions.

Rapportive

Rapportive may not have been designed specifically for small businesses, but it sure makes life for pretty much any business owner easier. The Gmail plugin creates a widget that sits to the right of any open email message and culls data from the Web to tell you exactly who miscellaneousperson@whateverbusiness.com really is.

Depending on how readily available such details are, Rapportive will pull an avatar image, name, job title, recent tweets and links to any active social networking profiles the person may have. You can even connect with somebody on LinkedIn via Rapportive, without leaving Gmail.

John Fund is very, very upset over the FCC's weaksauce Net Neutrality declarations and he's aiming at 'wealthy left-wing' organizations as the culprits. This makes me happy. When a winger can only squirm over something so weak and toothless as to be useless, it's a good day. But look at who he aims at! Paranoid, much?

Free Press and allied groups such as MoveOn.org quickly got funding. Of the eight major foundations that provided the vast bulk of money for campaign-finance reform, six became major funders of the media-reform movement. (They are the Pew Charitable Trusts, Bill Moyers's Schumann Center for Media and Democracy, the Joyce Foundation, George Soros's Open Society Institute, the Ford Foundation, and the John D. and Catherine T. MacArthur Foundation.) Free Press today has 40 staffers and an annual budget of $4 million.

These wealthy funders pay for more than publicity and conferences. In 2009, Free Press commissioned a poll, released by the Harmony Institute, on net neutrality. Harmony reported that "more than 50% of the public argued that, as a private resource, the Internet should not be regulated by the federal government." The poll went on to say that since "currently the public likes the way the Internet works . . . messaging should target supporters by asking them to act vigilantly" to prevent a "centrally controlled Internet."

To that end, Free Press and other groups helped manufacture "research" on net neutrality. In 2009, for example, the FCC commissioned Harvard University's Berkman Center for Internet and Society to conduct an "independent review of existing information" for the agency in order to "lay the foundation for enlightened, data-driven decision making."

Considering how openly activist the Berkman Center has been on these issues, it was an odd decision for the FCC to delegate its broadband research to this outfit. Unless, of course, the FCC already knew the answer it wanted to get.

Wow. Openly activist? The Berkman Center? Here's the Berkman Center's Berkman@10 page, with some of their research projects and discussions posted online. Such terribly activist things. Open innovation, The Dilemma of Games, The Musician and the Scientist, and yes, Network Neutrality (not Internet Neutrality, by the way), as well as one called The Battle for the Web. Hardly activist.

Current projects include a Law Library wiki, a discussion of money in politics, and a paper about online political organizing. Again, not activist. Wonky. Educational. But not activist. I confess to zooming in on Fund's remarks about Berkman because I am a huge fan and avid reader of Doc Searls, who has been a Berkman Fellow for the past 4 years.

Berkman aside, the issue of Net Neutrality has always been about a democratic internet, one where everyone has equal access to content and pipes. The organizations Fund villifies in his post are organizations dedicated to the preservation of freedom of speech and free flows of information, so I'm struggling to reconcile the conservative maxim of constitutional freedoms above all with his abuse of organizations who strive to protect it.

I didn't have to struggle too long. A closer reading of his rant reveals a corporate agenda which trumps any speech rights.

The net neutrality vision for government regulation of the Internet began with the work of Robert McChesney, a University of Illinois communications professor who founded the liberal lobby Free Press in 2002. Mr. McChesney's agenda? "At the moment, the battle over network neutrality is not to completely eliminate the telephone and cable companies," he told the website SocialistProject in 2009. "But the ultimate goal is to get rid of the media capitalists in the phone and cable companies and to divest them from control."

A year earlier, Mr. McChesney wrote in the Marxist journal Monthly Review that "any serious effort to reform the media system would have to necessarily be part of a revolutionary program to overthrow the capitalist system itself." Mr. McChesney told me in an interview that some of his comments have been "taken out of context." He acknowledged that he is a socialist and said he was "hesitant to say I'm not a Marxist."

I am neither a socialist nor a Marxist, but I believe that the Internet should be preserved as something everyone can access equally, and am frustrated on a near-daily basis by the stranglehold providers have on that access. Fund's suggestion that net neutrality and regulatory authority over access somehow stifles innovation is to believe that the sole innovators are cable and telephone companies. In fact, the opposite is true. The true innovation has come from many different sources, including inhabitants of the Internet itself.

Facebook, Twitter, Google and blogs were not the invention of AT&T, after all.

The real threat to innovation is handing the keys to all of the Internet gates to the likes of Comcast, AT&T and Verizon. And yet, that is exactly what the FCC did with their weird ruling yesterday.

Making Money Scams

This year, more than 600 taxi drivers were implicated in a giant taxi scam in which drivers overcharged passengers more than $1.1 million by flipping switches on their meters that kicked in higher rates. In the wake of the scandal, the Taxi and Limousine Company scrambled to portray the incident as a series of isolated incidents and mistakes by a select number of drivers. But according to one of those taxi scammers, these were no Lee Harvey Oswalds: it really was all a giant evil conspiracy!

According to driver Joseph Kastner, a group of drivers would meet together at cabby conferences in garages around the city and plot their nefarious schemes. "I met a series of drivers who decided to rob the public. They were actually having meetings at my old garage," Kastner, 49, told the TLC during a Sept. 30 administrative court hearing. Kastner is one of those accused drivers; he is charged with allegedly cheated 3,925 passengers out of $7,756, the sixth highest amount for an individual driver. Kastner claims that he wanted to become a whistleblower, alleging that the scams were much bigger than let on previously, and that he had stuff on the TLC as well, but no one took his offer: "I tried to tell them over and over again at the hearing. They didn't listen to a word I said. They just don't want to hear it," he told the Post.

So is Kastner trying to escape his fate by alleging a citywide conspiracy, making up stories to look better, or is there really an underground network of thieving taxi drivers plotting to steal unwitting customer's money? TLC obviously didn't take his claims seriously, but the Post sides with Kastner, saying that other cabbies and industry insiders confirm his story, and bad hacks pull other stunts such as charging drivers to put on the heat, pressing the "extra" button on tolls and bridges, and posing as livery drivers at airports and charging more than double the flat fee of $45 to Manhattan. Whether or not the conspiracy is as widespread as Kastner would have you believe, the best thing you can do is consult the Passenger Bill of Rights, and always be vigilant of extra charges of any kind.

Even as India basks in the respect showered on it as a player on the global stage by President Barack Obama, a wave of despondency is rising among almost all sections of the people at the rampant corruption corroding its politicians, bureaucrats and media.

Recent revelations indicate misappropriation of nearly $900 million in various scams orchestrated by senior politicians, ministers and top officials. The latest episode was the disappearance of some $200 million in the run up to the 2010 Commonwealth Games in October and new information about a $400 million misappropriation some years ago during allocation of cellular telephone licenses. A particularly painful recent revelation was the allocation of heavily subsidized apartments in a prime area of Mumbai to senior military figures, bureaucrats and politicians instead of the war widows and war wounded for whom they were meant as a grateful nation’s thanks.

A crucial leadership meeting today of India’s venerable Congress Party, which heads the current national coalition government, failed to make corruption a main driver of its political agenda. Congress leaders blamed high level figures in the opposition parties for some of the corruption cases highlighted by the media, thus making corruption a political issue instead of a national scandal cutting across Party lines.

Prime Minister Manmohan Singh, who is widely admired for his personal incorruptibility, and Congress President Sonia Gandhi fueled a sense of helplessness at the impunity of the corrupt when they denounced this malevolence but remained silent about allegations against top Congress politicians and leaders of coalition allies.

Corruption is thought to be embedded deeply at every level, high or low, of every institution of national democracy, including the judiciary, police, tax administration, top administrative officials and politicians. Indian laws disallow investigation or prosecution of politicians without parliament’s permission and of middle and senior bureaucrats without permission from the cabinet of ministers.

There is no institution beyond the control of government or bureaucracy with independent investigative powers and the authority to prosecute politicians or officials. Although draconian laws exist to prevent and punish the corrupt, they are rarely applied and have failed as deterrents.

Obama’s visit and thoughtful words seem to have opened Indian minds to the extraordinary potential of their country. For the first time the leader of the Western world is offering India a seat at the top economic and security tables as a partner. China sits at the top tables because it is feared and its intentions are suspect. India is being asked as a friend.

Suddenly, previous US rhetoric about India’s valued role in world affairs has changed into genuine belief in her ability to help create a more equitable, secure and people-friendly world order. This has jolted Indians out of resignation to being exploited by institutionalized corruption in all corridors of power.

In general, India is dynamic, creative and youthful compared to Western nations, China and Japan. There is energy and excitement about economic growth and making money. But Obama’s visit heightened realization that corruption is a greater enemy of better lives for Indians than poverty and other material shortages.

Disappointment is growing because of recognition that the people cannot trust any institution to impartially uncover and punish the corrupt. The discovery that some senior army generals were involved in Mumbai’s real estate scandal has caused consternation because the army was widely admired for being incorruptible.

A feeling of helplessness is rising because there seem to be no workable solutions, although politicians rail against corruption across Party lines. It turns out that everybody is naked because Sonia Gandhi and Manmohan Singh, both known for their probity, are reluctant to aggressively implement anti-corruption drives within their own Party while making shrill accusations against opposition figures. They fear to open a Pandora’s Box capable of bringing down the government by causing severe losses for the Congress and its allies in elections at the State and local levels.

Even the media is no longer trusted as an honest filter between the powerful and the people. This is mainly because major newspapers and TV channels do not clearly differentiate sponsored news and analysis from genuine reporting.

Transparency international ranks India at 87th place in its index of corrupt countries. There is little hope that things will change dramatically for the better soon.

'Tis the holiday season, and for businesses that means considering how to indulge employees with vacation time, holiday parties and, the most loaded perk, holiday bonuses.

Holiday bonuses are a longtime tradition for industries like finance — think the big Wall Street firms that get Christmas bonuses the size of annual salaries — and the National Labor Relations Board has allowed unionized workers to make holiday bonuses a contractual obligation. But small businesses operate in a nebulous realm of personal discretion, where owners set their own precedent for holiday extras.

Owners can establish gifts around the holidays as an act of goodwill or as part of employees' pay package, says Harry Dannenberg, chairman of the New York City chapter of SCORE, a national nonprofit organization that offers small business counseling and advice. "It's such a personal issue that there's not a precedent for it," he says. "Different industries have different attitudes about it. If you're a mom-and-pop operation and you're part of a business family, you might have a more generous approach to the holidays than if you run a chain."

In a survey last December, Challenger, Gray & Christmas, an outplacement consulting firm, found that 64 percent of employers planned to give holiday bonuses, up from 54 percent in 2008, when most industries were strained by a bad economy. Greater economic conditions certainly play into whether to give a holiday bonus, Dannenberg says, but it's good form to show employees appreciation for a successful year. "If I had a good year and people worked very hard for me, I might make a statement of how grateful we all are by presenting them with a nice gift," he says. "But it's very individual, especially with small businesses, and how you relate to the people who work for you."

This year's holiday bonus will set the precedent for subsequent years', so structuring bonuses to be affordable yet considerate is key.

How to Structure a Holiday Bonus: Decide its Purpose

What role will a holiday bonus play in your overall, yearlong pay scheme? Is it a substitute for a year-end bonus? Is it a substantial contribution to annual pay? Or is it a token of holiday spirit?

If a business already pays a year-end bonus, a holiday bonus becomes more of a gift of appreciation than part of employees' annual pay and benefits package, Dannenberg says. "If you're in a business where you get year-end bonuses, usually Christmas becomes far less of a significant issue," he says. "If you're a clerk in the store and the owner wants to spread a little cheer and give some money, give families turkeys, it becomes a small thank-you. A big thank-you is a raise or a year-end bonus."

    Ben Hemminger, CEO of Fashionphile, a Beverly Hills company that sells second-hand luxury handbags, says he gives a year-end bonus around the holidays. The family-owned business has 11 employees, mostly part-timers, and the full-time employees "are all related to me," he says. Full-timers get a $500 check — taxes deducted and all — around the last week of December, and part-timers receive a $100 cash card. "There's probably a more intriguing way to do it," he says, "but everybody would rather have the money than something worth the money."

Dannenberg agrees that token thank-yous like cash cards belong at the general employee level, not the management level. "It should be given to employees who provide a service in a business," he says. "In something like auto repair or retail, it becomes more of a gesture of recognition of service."

How to Structure a Holiday Bonus: Budgeting the Bonus

Holiday bonuses meant as tokens of appreciation don't belong in a business plan, Dannenberg says. Rather, he suggests looking at revenue from the first 10 months of the year to decide how to approach bonuses each holiday season. "Say it was a good year, I made money, therefore, on the strength of that performance, I can give 'x,'" he says. But use generosity in moderation, Dannenberg warned. Being too generous in a good year could make for an embarrassing downgrade in a bad year.

Six-year-old Fashionphile spends a few thousand dollars on year-end bonuses and year-end gifts for its part-time employees, but Hemminger says everyone understands the bonus is a small token. "No one gets paid a whole lot to begin with, so it's not like we have high expectations," he says.

Start-up businesses should do some footwork before deciding how to approach bonuses, Dannenberg says. "The issue becomes what is the precedent," he says. "If I were starting a new business, I would go around and chat with other similar merchants to see what they do. Get a feel for how other people make that evaluation and judgment."

How to Structure a Holiday Bonus: Cash versus Gift

If a holiday bonus isn't an established part of annual pay, a gift is just as meaningful as a little cash — sometimes more so if the cash gift is going to be small. "You give someone a really small amount, it's insulting," Dannenberg says. "But give them a nice bottle of wine and something that costs $10, it's nice. With a nice note, it's an expression of thanks, a matter of holiday spirit and cheer."

Hemminger says he's considering giving employees gift cards for the three restaurants they go to for lunch every day — a tax-free and useful gift, he says.

The employer designs the book from size and shape to content — photos or photos and text. Square books start at around $13.

When Dannenberg owned a chain of six retail stores, around the holidays he would give employees a big basket filled with fruit and a turkey. "They grew to look forward to it and enjoy it," he says, adding, "I would stay away from giving money at Christmas because of the potential cost.

 "I'd go with a nice box of candy and a bottle of wine, something that you can have uniformity that everyone can enjoy."

So as you decide how to handle the holidays, keep in mind that whether it's cash or wine, to employees, it's your appreciation for their service that counts.

'Tis the holiday season, and for businesses that means considering how to indulge employees with vacation time, holiday parties and, the most loaded perk, holiday bonuses.

Holiday bonuses are a longtime tradition for industries like finance — think the big Wall Street firms that get Christmas bonuses the size of annual salaries — and the National Labor Relations Board has allowed unionized workers to make holiday bonuses a contractual obligation. But small businesses operate in a nebulous realm of personal discretion, where owners set their own precedent for holiday extras.

Owners can establish gifts around the holidays as an act of goodwill or as part of employees' pay package, says Harry Dannenberg, chairman of the New York City chapter of SCORE, a national nonprofit organization that offers small business counseling and advice. "It's such a personal issue that there's not a precedent for it," he says. "Different industries have different attitudes about it. If you're a mom-and-pop operation and you're part of a business family, you might have a more generous approach to the holidays than if you run a chain."

In a survey last December, Challenger, Gray & Christmas, an outplacement consulting firm, found that 64 percent of employers planned to give holiday bonuses, up from 54 percent in 2008, when most industries were strained by a bad economy. Greater economic conditions certainly play into whether to give a holiday bonus, Dannenberg says, but it's good form to show employees appreciation for a successful year. "If I had a good year and people worked very hard for me, I might make a statement of how grateful we all are by presenting them with a nice gift," he says. "But it's very individual, especially with small businesses, and how you relate to the people who work for you."

This year's holiday bonus will set the precedent for subsequent years', so structuring bonuses to be affordable yet considerate is key.

How to Structure a Holiday Bonus: Decide its Purpose

What role will a holiday bonus play in your overall, yearlong pay scheme? Is it a substitute for a year-end bonus? Is it a substantial contribution to annual pay? Or is it a token of holiday spirit?

If a business already pays a year-end bonus, a holiday bonus becomes more of a gift of appreciation than part of employees' annual pay and benefits package, Dannenberg says. "If you're in a business where you get year-end bonuses, usually Christmas becomes far less of a significant issue," he says. "If you're a clerk in the store and the owner wants to spread a little cheer and give some money, give families turkeys, it becomes a small thank-you. A big thank-you is a raise or a year-end bonus."

    Ben Hemminger, CEO of Fashionphile, a Beverly Hills company that sells second-hand luxury handbags, says he gives a year-end bonus around the holidays. The family-owned business has 11 employees, mostly part-timers, and the full-time employees "are all related to me," he says. Full-timers get a $500 check — taxes deducted and all — around the last week of December, and part-timers receive a $100 cash card. "There's probably a more intriguing way to do it," he says, "but everybody would rather have the money than something worth the money."

Dannenberg agrees that token thank-yous like cash cards belong at the general employee level, not the management level. "It should be given to employees who provide a service in a business," he says. "In something like auto repair or retail, it becomes more of a gesture of recognition of service."

How to Structure a Holiday Bonus: Budgeting the Bonus

Holiday bonuses meant as tokens of appreciation don't belong in a business plan, Dannenberg says. Rather, he suggests looking at revenue from the first 10 months of the year to decide how to approach bonuses each holiday season. "Say it was a good year, I made money, therefore, on the strength of that performance, I can give 'x,'" he says. But use generosity in moderation, Dannenberg warned. Being too generous in a good year could make for an embarrassing downgrade in a bad year.

Six-year-old Fashionphile spends a few thousand dollars on year-end bonuses and year-end gifts for its part-time employees, but Hemminger says everyone understands the bonus is a small token. "No one gets paid a whole lot to begin with, so it's not like we have high expectations," he says.

Start-up businesses should do some footwork before deciding how to approach bonuses, Dannenberg says. "The issue becomes what is the precedent," he says. "If I were starting a new business, I would go around and chat with other similar merchants to see what they do. Get a feel for how other people make that evaluation and judgment."

How to Structure a Holiday Bonus: Cash versus Gift

If a holiday bonus isn't an established part of annual pay, a gift is just as meaningful as a little cash — sometimes more so if the cash gift is going to be small. "You give someone a really small amount, it's insulting," Dannenberg says. "But give them a nice bottle of wine and something that costs $10, it's nice. With a nice note, it's an expression of thanks, a matter of holiday spirit and cheer."

Hemminger says he's considering giving employees gift cards for the three restaurants they go to for lunch every day — a tax-free and useful gift, he says.

The employer designs the book from size and shape to content — photos or photos and text. Square books start at around $13.

When Dannenberg owned a chain of six retail stores, around the holidays he would give employees a big basket filled with fruit and a turkey. "They grew to look forward to it and enjoy it," he says, adding, "I would stay away from giving money at Christmas because of the potential cost.

 "I'd go with a nice box of candy and a bottle of wine, something that you can have uniformity that everyone can enjoy."

So as you decide how to handle the holidays, keep in mind that whether it's cash or wine, to employees, it's your appreciation for their service that counts.
